4 Legal Documents You Need to Care for Aging Parents

If you are the caregiver for an aging parent or other relative, there are four legal documents that are critical for you to have in order to do your duty effectively. These include:

1. Durable power of attorney. This document provides the authority for you to manage another person's finances in case he or she becomes incapacitated. Be sure that the banks and brokerage firms your relative uses recognizes a power of attorney; if they don't, your relative will need to execute the proper paperwork to allow you to act with those institutions on their behalf.

2. Advance medical directive. Also known as a power of attorney for health care, an advance medical directive provides you with the authority to make medical decisions on behalf of your relative when they are unable to do so for themselves.

3. Medical information release. This medical form - also called a HIPAA release form - allows medical professionals to share your relative's medical information with you. This form should be executed and copies provided to your relative's primary care physicians.

4. Living will. This document allows your relative to provide guidance on end-of-life care issues, and can be particularly useful if they become incapacitated and another family member objects to treatment choices.
